What California Law Says About a First-Offense DUI

Oakland DUI charges most commonly arise under two theories in California Vehicle Code section 23152. Under 23152(a), the prosecution must show you were driving while impaired by alcohol or drugs based on observable behavior, regardless of your measured blood alcohol concentration. Under 23152(b), a BAC of 0.08% or higher is sufficient evidence on its own, a per se violation. Drivers under 21 face a far lower threshold: 0.02% under California’s zero-tolerance law.

“First offense” has a specific legal meaning: no prior DUI convictions within the past 10 years. Most first-offense DUIs are charged as misdemeanors, though the charge can become a felony if the incident involved an injury accident. Charges in Oakland arise from Oakland Police Department traffic stops, California Highway Patrol patrols, and sobriety checkpoint operations throughout Alameda County.

What a First Conviction Can Cost You

Even without a prior record, the consequences of a first-offense DUI conviction in California are significant:

  • Fines and court fees can total $2,000 or more when assessments are added
  • Jail exposure ranges from 96 hours to six months
  • License suspension of six months through the criminal court
  • DUI school of three to nine months, mandatory in Alameda County
  • Ignition interlock device installation and ongoing maintenance costs
  • Informal probation for up to five years
  • Insurance consequences including sharply higher premiums or carrier denial

A DUI conviction stays on your driving record for 10 years and on your criminal history unless expunged. Employers, landlords, and professional licensing boards can access that record on a background check. Aggravating factors such as a BAC of 0.15% or higher, a test refusal, an accident, or a passenger under 14 can increase penalties even on a first offense.

Two Proceedings, One Attorney

A DUI arrest in Oakland triggers two separate legal processes running at the same time. Most people don’t realize the DMV process begins immediately and operates completely apart from the criminal case.

The DMV Administrative Hearing

When you’re arrested, the officer takes your physical license and issues a pink temporary document valid for 30 days. You have 10 days from the date of arrest to contact the California DMV and request an administrative per se hearing to challenge the suspension. Miss that window and the suspension becomes automatic. For a first offense where you took a chemical test, the DMV suspension is four months. Refusing or failing to complete a chemical test triggers a one-year suspension under California’s implied consent law, regardless of age. We can request this hearing on your behalf and represent you through the entire DMV process.

The Criminal Case at Alameda County Superior Court

Oakland DUI arraignments are heard at the Wiley W. Manuel Courthouse in downtown Oakland. At arraignment, formal charges are read, you enter a plea, and the court sets release conditions and future dates. We can appear at many early proceedings on your behalf, which can reduce the time you’ll need away from work. We also stay present on long, unpredictable court days rather than disappearing when schedules shift.

How We Build Your Defense

Every first-offense DUI case in Oakland is different. We start by asking detailed questions, then reviewing police reports, chemical test records, and all evidence from the stop and arrest. What we’re looking for:

  • Stop legality: an officer must have reasonable suspicion of a traffic violation before pulling you over. A stop without legal basis can be challenged through a motion to suppress under California Penal Code section 1538.5, which can support reduced charges or dismissal
  • Field sobriety tests: these are voluntary in California, and if you performed them, we examine how they were administered
  • Chemical test accuracy: breath and blood testing requires strict protocols. Calibration errors, improper sample handling, or certain medical conditions that produce falsely elevated readings can all undermine BAC results

When BAC readings are near the legal limit or testing has reliability problems, Alameda County prosecutors may be open to negotiating a reduction to reckless driving under Vehicle Code sections 23103 and 23103.5, commonly called a wet reckless. That reduction carries lighter penalties and fewer long-term consequences than a DUI conviction. Alternative sentencing for first-time offenders can also include community service, informal probation, or participation in a MADD Victim Impact Program. We handle all prosecutor communication directly so you’re protected from missteps in negotiation.

Direct Representation & Plain Communication

You work with Demetrius Costy directly. Not a rotating associate, not a paralegal passing messages. The same attorney who answers your first call is the one in court with you. We return calls quickly, including after hours, because questions don’t wait for business hours when you’re facing a criminal charge.

We speak plainly. Legal jargon gets translated into language you can actually follow. We set realistic expectations from the start, explain our strategy and why we’re pursuing it, and help you make informed decisions at every stage. Our record includes dismissals, reduced charges, and recalled warrants. Fair fees and payment flexibility mean strong representation doesn’t have to be out of reach during a financial crisis.
